Under California law, the categories of personal information we collect are: identifiers; customer records information; commercial information; internet or network activity; approximate geolocation data; and inferences drawn from the above. We do not collect sensitive personal information as that term is defined by the CPRA, and we do not use or disclose any information for purposes that would require an opt-out of sensitive data processing.

4. Who we share your information with
We do not sell your personal information for money. We share it with service providers who need it to do their job for us, under contracts that require them to protect it:
- Shopify Inc. — our ecommerce platform, hosting and checkout
- Shopify Payments and card acquirers, Apple Pay, Google Pay, Shop Pay — payment processing
- USPS, UPS, FedEx, DHL eCommerce — delivery of your parcel

Because our company is registered in the United Kingdom and our providers operate globally, your information may be stored or processed outside the United States, including in the UK and the European Union. We require our providers to apply appropriate safeguards wherever the information is handled.
5. Advertising, "selling" and "sharing"
We do not sell your personal information for money.
However, our use of the Google Ads and Meta advertising tools means that identifiers and browsing activity may be shared with those platforms so that we can measure our advertising and show you relevant ads. Under California, Colorado, Connecticut, Virginia, Texas and several other state privacy laws, this may be treated as "sharing" for cross-context behavioral advertising, or as targeted advertising.
You can opt out at any time:
- Use the Do Not Sell or Share My Personal Information link in our site footer
- Adjust your choices through the cookie settings link on our site
- Turn on the Global Privacy Control (GPC) in a supported browser or extension — we treat a GPC signal as a valid opt-out request for the browser it is sent from
We do not knowingly sell or share the personal information of consumers under 16 years of age.
6. How long we keep your information
- Order and transaction records: 7 years, to meet accounting and tax obligations
- Customer service correspondence: 3 years after the matter is closed
- Newsletter subscriptions: until you unsubscribe, plus a suppression record so we do not email you again
- Website analytics data: typically 14 months, depending on the tool
- Cookie and opt-out preference records: 12 months
After these periods we delete or irreversibly anonymize the information.
7. Cookies and tracking
Cookies are small files placed on your device. We use:
- Strictly necessary cookies — to run the cart, checkout, login and security. The store cannot function without them.
- Analytics cookies — to understand how the site is used, so we can improve it.
- Marketing and advertising cookies — including the Google Ads and Meta pixels, to measure the results of our advertising and to show relevant ads.
You can change your preferences at any time through the cookie settings link on our site, and you can block or delete cookies in your browser settings. Blocking strictly necessary cookies will stop the store working correctly.
8. Your privacy rights
Depending on the state you live in, you may have the right to:
- Know and access the categories and specific pieces of personal information we have collected about you, where we got it, why we collected it and who we shared it with
- Delete the personal information we hold about you, subject to exceptions such as completing your order or meeting our tax obligations
- Correct personal information that is inaccurate
- Opt out of the sale or sharing of your personal information, and of targeted advertising (see section 5)
- Data portability — receive your information in a portable, readily usable format
- Non-discrimination — we will not deny you goods or services, charge you a different price or give you a lower quality of service because you exercised a privacy right
- Appeal a decision we make about your request, where your state's law provides for this. Email us with "Privacy Appeal" in the subject line and we will respond within 45 days.
We do not carry out profiling that produces legal or similarly significant effects about you.
California residents may also request, once a year, details of any personal information disclosed to third parties for their direct marketing purposes ("Shine the Light", Cal. Civ. Code § 1798.83).
How to make a request: email info@elaineclaire-boutique.com. We confirm receipt within 10 business days and respond within 45 days, and may extend by a further 45 days where a request is complex — we will tell you if that happens. There is no charge. We may ask you to confirm your identity, usually by matching your email address and order details, before we release information. An authorized agent may submit a request on your behalf with written permission, and we may ask you to verify your identity directly.
Complaints: if you are unhappy with how we handle your information, contact us first. You may also complain to the attorney general in your state — California residents can contact the California Privacy Protection Agency at cppa.ca.gov or the California Attorney General at oag.ca.gov.
9. Marketing emails
If you subscribe, we will email you about new arrivals, collections and offers. Every email contains a one-click unsubscribe link, and you can also email us to be removed. We process unsubscribe requests within 10 business days, as required by the CAN-SPAM Act. Unsubscribing from marketing does not stop transactional emails about an order you have placed — those are part of fulfilling your purchase.
10. Security
We use TLS encryption across the site, restrict access to personal information to people who need it, and work only with providers who maintain appropriate security measures. No system is perfectly secure, but if a breach occurs that affects your personal information, we will notify you and any regulator as required by applicable state law.
11. Children
Our store is intended for adults. We do not knowingly collect personal information from anyone under 13, in line with the Children's Online Privacy Protection Act, and we do not knowingly sell or share the information of anyone under 16. If you believe a child has given us personal information, email us and we will delete it.
12. Changes to this policy
We may update this policy as our business or the law changes. Updates are published on this page with a revised date. If the change is significant, we will tell you by email or by a notice on the site.
